General conditions:

These terms and conditions (hereinafter – the Conditions) constitute a legal document, which is binding on both Parties and establishes the rights, obligations and responsibility of the Buyer and the Seller upon the Buyer’s procurement of the goods at the online shop.

The Seller remains the right to change, amend or supplement these Conditions in accordance with the requirements, established by the law. The Buyer is informed of these changes on the website of the online shop. The Buyer’s shopping at the online shop is subject to the Conditions, valid at the moment of placing the order.

Persons that are entitled to shopping at the online shop:

legally capable natural persons, i.e. adults, whose legal capacity has not been limited by a court ruling;

minors, aged 14-18, only with a permission of their parents or carers, except for cases, when they independently dispose of their income;;

legal entities;

authorised representatives of all of the above

An agreement between the Buyer and the Seller is regarded as concluded since the moment the Buyer clicks ‘Confirm the Order’ after creating a shopping cart, indicating the delivery address, choosing the payment method and reading and accepting the Seller’s Terms and Conditions.

Each agreement between the Buyer and the Seller is stored at the online shop.
Personal data protection:

There are two shopping modes available for the Buyer:

buying as a registered user by entering the registration data;

buying as an unregistered user.

Upon ordering goods (as a registered or unregistered user), the Buyer must enter their personal details into appropriate information fields, required for the delivery of the goods – name, surname, delivery address, phone number and e-mail.

The Buyer is responsible for providing the correct details upon placing an order at the online shop.

The details submitted may only be used for the purposes of online trade, business analysis, order fulfilment and direct marketing (newsletters, special offers/promotions, information). By submitting their personal details, the Buyer agrees that their e-mail and/or phone number will be used to deliver information notices, which are necessary for the fulfilment of the order.

By registering at the online shop and ordering the goods, the Buyer undertakes to protect their access details and refrain from their disclosure.
Buyer's rights and obligations.

The Buyer has a right to purchase goods at this online shop in accordance with the procedure, established in the Terms and Conditions herein.

The Buyer has a right to cancel the goods sale-purchase agreement with the e-shop by providing the Seller with a written notice (by e-mail, indicating the goods to be returned and the order number) no later than in 14 (fourteen) business days since the day of the delivery, except for cases, when this agreement cannot be cancelled in accordance with the law of the Republic of Lithuania (e.g. when the agreement involves hygiene goods – bed linen; see information on VšĮ Vartotojų Centras website http://www.vartotojucentras.lt/istatymas.php?id=1038 Ne maisto prekių grąžinimo ir keitimo ypatumai [Peculiarities of Returning and Replacement of Non-Food Items], clause 18).

The buyer can use the right to return the goods only if the goods are intact, there were no substantial changes to the way the item looks and also if it was not used.

The Buyer undertakes to accept the goods ordered and pay the agreed price.

In case of any changes in the details in the Buyer’s registration form, the Buyer must immediately update them.

The Buyer undertakes to refrain from sharing their access details to third persons. Should the Buyer lose their access credentials, they must immediately report this to the Seller using the means of communication, indicated in the ‘Contacts’ section.

By using the online shop, the Buyer agrees with the sale-purchase Terms and Conditions, indicated herein, undertakes to adhere to them and refrain from violating the legislation of the Republic of Lithuania.
Seller’s rights and obligations.

The Seller undertakes to provide all conditions for the Buyer’s proper use of the services, offered at the online shop.

Should the Buyer attempt to disrupt the stability and safety of the business of the Seller’s online shop, or violate one’s obligations, the Seller has a right to limit or cancel the Buyer’s possibility of using the online shop or, in exceptional cases, delete the Buyer’s shopping account, immediately and with no prior warning.

The Seller undertakes to respect the Buyer's privacy and personal information, indicated in the registration form of the online shop.

The Seller undertakes to deliver the goods, ordered by the Buyer at the address, indicated by the Buyer.
Ordering/purchasing of the goods, payment procedure.

Shopping at the online shop is available 24/7..

Upon visiting the online shop, the Buyer selects the goods that they like. Their picks are placed in a shopping cart.

Before confirming the order, the Buyer must ensure that the shopping cart contains only the goods that they are intending to buy and that all the details are correct.

The agreement comes into force upon the moment the Buyer clicks the ‘Confirm the Order’ and, upon receiving the order, the Seller approves it by delivering a confirmation notice to the Buyer’s e-mail.

The prices at the online shop and the order are indicated in euro.

The Buyer can pay for the goods using one of the following methods:

Bank transfer – an advance payment, when the Buyer transfers the money into the shop’s banking account upon receiving the payment details.

Using PayPal.

Using Paysera.

The Buyer undertakes to pay for the goods immediately. The package will be prepared only upon receiving the payment. It will also be regarded as the beginning of the delivery term.

The Buyer takes full responsibility for providing the correct details.
Delivery.

Upon selecting the delivery service, the Buyer undertakes to indicate a precise delivery location.

The Buyer undertakes to pick up the goods in person. Should the Buyer be unable to pick up the goods in person, when the goods are delivered to the address indicated, the Buyer is not entitled to make any claims against the Seller regarding the delivery of the goods to an improper subject.

Orders are dispatched in 1-3 business days after full payment. All packages are delivered by registered priority mail using Lithuanian postal services (except for DHL Express delivery). Information with the package tracking number is provided upon dispatch.
Express delivery:
This is a faster way of getting the package. The package will be dispatched using DHL services. Delivery time: 1-4 business days.
If you choose express delivery service, indicate your phone number so that the courier can find you.

The Seller will do everything to adhere to all the delivery terms indicated, but cannot be held responsible for the term of delivery, implemented by third parties. Therefore, in all cases, the Seller is relieved of the liability for late delivery of the goods in cases, when the goods were not delivered to the Buyer on time due to the Buyer’s fault or because of circumstances that do not depend on the Seller, including, but not limited to actions or lack thereof of the third parties, delivering the package.

Upon delivery of the goods to the Buyer’s indicated address, it will be regarded that the goods were transferred to the Buyer.

Should the Buyer indicate a wrong or incomplete delivery address or should the Buyer fail to pick up the goods from the delivery service provider in the maximum package storage term, the Buyer must cover the additional costs for the return of the package and the repeated delivery of the goods to the address, specified by the Buyer.

In all cases, the Buyer must immediately inform the Seller if the package was damaged, if it contains wrong goods or a wrong amount of the goods, also if the goods are incomplete.

In all cases, upon noticing package damage, the Buyer must indicate this in the delivery document, provided by the courier, or issue a separate statement regarding damage. The Buyer must do this in the presence of the courier. In case of failure to do so, the Seller is relieved of any responsibility against the Buyer regarding the damage of the goods, related to packaging damage, that was not indicated by the Buyer in the courier’s delivery documents.
Warranty:

The details of the goods, offered at the online shop, are indicated in the description near each of the goods.

The goods, offered online, may look slightly different from the actual items in terms of size and colours, depending on the buyer’s monitor settings. This should not be regarded as lack of quality or non-compliance to the description. The goods offered are made of only genuine Baltic amber and that is a special stone – each piece is unique and thus some items may slightly differ.

Rubbing against each other or other surfaces could damage amber jewellery, so it is advisable to keep them separate, avoid contact with rough surfaces, dropping or other mechanical impact. You should also take care to protect your jewellery from chemical substances, sudden temperature changes, heat and saline or chlorinated water.
Return and replacement.

Defects of the goods sold will be eliminated and defective goods can be replaced or returned based on the Order No. 217 ‘Regarding the Approval of the Regulations for the Return and Replacement of Goods’, issued by the Minister of Economy of the Republic of Lithuania on 29 June 2001. This does not apply to cases, when this agreement cannot be cancelled in accordance with the law of the Republic of Lithuania (e.g. when the agreement involves hygiene goods – bed linen; see information on VšĮ Vartotojų Centras website http://www.vartotojucentras.lt/istatymas.php?id=1038 Ne maisto prekių grąžinimo ir keitimo ypatumai [Peculiarities of Returning and Replacement of Non-Food Items], clause 18). In all cases, the money for the goods returned will be transferred only to the banking account of the person that had made the payment.

The Buyer can return the goods in 14 (fourteen) business days since the delivery of the goods to the Buyer upon giving a notice to the Seller using the means of communication, indicated in the ‘Contacts’ section and indicating the title of the goods, the order number and the reason for the return.

The return of the goods is subject to the following conditions:

the goods returned must be in the original packaging and the packaging must be undamaged;
-
the goods must be undamaged by the Buyer;
-
the goods must be unused and in a marketable condition (with all labels, protective film, etc.) (this clause does not apply in case of returning defective goods);
-
the goods returned must be in the same arrangement as received by the Buyer;
-
the goods returned must be accompanied with the purchase document.

The Seller has a right to refuse to accept the returned goods if the Buyer fails to comply with the established procedure of returning the goods..

The Buyer must dispatch the returned goods by registered mail or via a courier service. The Buyer must cover the return costs. Should we notice any deficiency in the goods returned or signs that the goods were worn, we remain a full right to refuse to accept the goods or return the money to the Buyer.

Upon receiving the goods returned and making sure that it has not been damaged, the money will be returned to the Buyer’s banking account indicated (except for the delivery costs).
Liability of the Buyer and the Seller.

The Buyer takes full responsibility for providing the correct personal details. Should the Buyer fail to provide precise personal details in the registration form, the Seller will not be held responsible for the resulting outcome and acquires the right to claim a compensation for direct losses incurred from the Buyer..

The Buyer is responsible for the actions made while using this online shop.

Upon registration, the Buyer is responsible for sharing their access details with third persons. Should the services of the online shop be used by a third person, using the Buyer’s credentials, the Seller will regard this person as the Buyer.

The Seller is relieved of any responsibility for the losses incurred, when the Buyer, regardless of the Seller’s recommendations and the Buyer’s obligations, failed to get acquainted with these Terms and Conditions, although this opportunity was provided.

Should the Seller’s online shop contain reference to websites that belong to other companies, institutions, organisations or persons, the Seller cannot be held responsible for the information contained therein or their business, does not administer or control these websites, and also does not represent these companies and persons.

In case of damage, the guilty Party will remunerate the direct losses, incurred by the other Party.
Marketing and information.

The Seller can make various offers at the online shop at their own discretion.

The Seller has a right to change the conditions of the offers and also withdraw the offers at their own discretion and without a separate notice. Any changes in the conditions and procedure of the offers is valid only as of the moment they were made.

The Seller sends all messages using the means of communication, indicated in the Buyer’s registration form.

The Buyer addresses all statements and questions using the phones and e-mails, indicated in the Seller’s online shop’s ‘Contacts’ section.

The Seller cannot be held responsible if the Buyer does not receive any information or confirmation messages due to disruptions of the internet connection or e-mail service.
Final provisions.

These goods sale-purchase Conditions are compiled in accordance with the law and legislation of the Republic of Lithuania.

All disputes regarding the adherence to these Conditions, must be settled by negotiations. In case of failure to come to a concord, the disputes will be settled in accordance with the procedure, established in the law of the Republic of Lithuania.
